“WIN A SMART CAR” CONTEST 2008

CONTEST RULES

1. Commencing 2PM EST August 22nd, 2008, and through until the close of Fan Expo Canada at 6PM EST on August 24, 2008 (the “Contest Period”), eligible participants may enter the harcorenerdity.com “Win a Smart Car” Contest (the “Contest”). To enter the Contest, be an eligible participant and to claim the Prize, refer to the Contest rules (the “Rules”) which follow.
   
   
2. NO PURCHASE NECESSARY. To receive one entry into the Contest, an eligible participant can: (a) visit Fan Expo Canada 2008 in person at the Metro Toronto Convention Centre during the Contest Period and open a profile account on the www.hardcorenerdity.com web site, which is equal to a entry ballot (“Ballot”) with your name, e-mail address; or (b) visit the www.hardcorenerdity.com web site from anywhere during the Contest Period and obtain a Ballot when opening a profile account, including your name and e-mail address, All entries must be received prior to 6PM EST on August 26, 2008 (the “Contest Closing Date”). Entries are void where prohibited by law. Limit one entry per person.
    
   
3. MINIMUM ENTRIES REQUIRED. For this Contest to run to completion, with the potential to award the Prize, at least 10,000 new, individual and eligible participants must open a profile account and obtain a Ballot at www.hardcorenerdity.com during the Contest Period. 
   
   
4. PRIZE AVAILABLE. One (1) 2009 Smart Car vehicle; is available to be won (the “Prize”).  Anticipated approximate retail value is estimated to be $20,000 CDN as at time of printing of these Rules. Approximate retail value in Canada is before any applicable taxes and includes Freight & P.D.I.  Any estimated retail values set out above do not include applicable goods and services tax, provincial or sales and use taxes.  Winner is not required to pay such tax upon receipt of the prize. All other taxes on prizes other than taxes specifically referred to in these rules are the responsibility of the winner. The winner is responsible for licensing, insurance and registration of the vehicle, plus all vehicle maintenance including fuel costs and any repairs. Winner shall take delivery of the vehicle at winner’s residence.
   
   
5. ELIGIBILITY. To be eligible as a Prize claimant, participant must be a legal resident of Canada (excluding Quebec) who has reached the age of majority in the province or territory in which he or she resides.  Residence shall be based on where a prize claimant ordinarily resides.  In the event of a dispute, the jurisdiction of residence shall be determined by Hardcorenerdity.com (the “Contest Sponsor”) in its sole discretion based on evidence provided by Prize claimant.  Contest Sponsor reserves the right to make independent investigation, if necessary. 
   
   
6. PRIZE DISTRIBUTION. Prize will be awarded to winner by Hardcorenerdity.com. Random draw for the Prize will be conducted by a representative of the Contest Sponsor, from all completed and valid Ballots received as of the Contest Closing Date and will be made on September 5,2008, at approximately 1:00 PM EST in Toronto, Ontario. The selected participant will be contacted by e-mail at the e-mail address indicated on their Ballot within three (3) business days of the draw. If a selected participant cannot be reached or if the participant declines the Prize, or does not otherwise comply with the Rules, including correctly answering the mathematical skill-testing question correctly, another random draw will be conducted to select a replacement participant in the same manner. The Prize must be accepted as awarded in the form solely decided upon by the Contest Sponsor. 
   
   
7. ODDS OF WINNING. The overall approximate odds of being eligible to win the Prize depend upon the number of valid entries made during the Contest Period and will change throughout the Contest Period as such numbers increase.
   
   
8. GENERAL RULES- The Contest shall run through the Contest Period.  To be a valid, Ballot entries must be received by 6PM EST on August 26, 2008.
   
   
9. Ballots generated through or by unauthorized sources or which are incomplete, altered, reproduced, fraudulent, counterfeited or irregular in any way, are automatically void. Contest Sponsor is not responsible for any lost, stolen, misdirected, delayed, not received, destroyed, damaged, illegible or incomplete Ballots or those that have been submitted through illicit means, or do not conform to or satisfy the Rules.
   
   
10. Any attempt to deliberately damage or undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Contest Sponsor is not responsible for any errors or omissions in printing or advertising this Contest.
    
    
11. The Contest Sponsor’s rulings are final and without appeal in all matters related to this Contest and the awarding of the Prize.
    
    
12. Employees of, members of the immediate family of, or those domiciled with an employee of Hardcorenerdity.com and their affiliated or related companies (collectively "Contest Sponsor"), and the advertising and promotion agencies of the Contest Sponsor are not eligible to participate. "Immediate family" is defined as parents, siblings, children or spouse.
    
    
13. By participating in this Contest, participants agree to be bound by these Rules and all decisions of the Contest Sponsor, which are final.  Prior to being declared the Prize winner, the selected participant will be required to complete a statement confirming compliance with the Contest Rules and acceptance of the Prize as awarded (“Statement”) as well as a publicity and liability release (“Release”). Selected participant will also be required to correctly answer, unaided, a time-limited mathematically skill-testing question to be administered by telephone at a mutually convenient time, before being named the Prize winner.  PLEASE NOTE:  Failure to complete and deliver the Statement and Release by September 10, 2008 shall make the Prize claim null and void and ineligible for the Prize and the Prize shall be forfeited.  Submission of complete and accurate information is the sole responsibility of the individual seeking to be declared winner and award of the Prize. Hardcorenerdity.com owners, operators and staff are not allowed to submit Ballots on behalf of participants or any information on behalf of potential winners. If the Prize is returned as undeliverable, Prize shall be forfeited.
    
    
14. By entering this Contest, each participant consents to the use of his or her entry, name, city of residence, and/or photograph in any publicity carried out by Contest Sponsor and its advertising and promotional agencies, dealers, agents and affiliates without further notice or compensation. All entries become the property of the Contest Sponsor and shall not be returned.
    
    
15. The Prize winner shall be notified by and shall receive the Prize from Hardcorenerdity.com.  No correspondence will be entered into except with potential winners. By participating in this Contest, a contest winner is deemed to have consented to the disclosure of their personal information to Prize suppliers for the limited purpose of delivery of the Prize and registration for warranty purposes.
    
    Prize must be accepted as awarded and is not convertible to cash. Prize may not be exactly as shown in promotional materials. In case of unavailability of the Prize or for any other reason and in Contest Sponsor’s sole discretion, Contest Sponsor reserves the right to substitute a prize.
    
    
16. By entering this Contest, participants release and hold harmless the Contest Sponsor and its affiliates, the Prize supplier, and their respective officers, directors, employees, agents, including without limitation, their advertising and promotional agencies, from any and all liability, loss or damage incurred in connection with this Contest.  Prize winner releases and holds harmless Contest Sponsor and its affiliates, the Prize supplier, and their respective officers, directors, employees and agents, including, without limitation, their advertising and promotional agencies, from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession and/or use or misuse of the Prize.  All participants acknowledge that Contest Sponsor and their officers, directors, employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied in fact or in law, including but not limited to quality, mechanical condition or fitness for a particular purpose.
    
    
17. The Contest Sponsor is collecting personal data about participants for the purposes of administering and operating their web site and administering this Contest.  For further information about the collection and use of your information, please refer to the www.hardcorenerdity.com privacy policy.
    
    
18. This Contest will run in accordance with these Rules, subject to amendment by the Contest Sponsor. Contest Sponsor reserves the right to cancel, amend, modify or terminate this Contest or the Rules at any time in its sole discretion and without further notice, for any reason, including if it determines that for any reason the Contest cannot be run as originally planned or any other occurrence compromising the fairness or integrity of the Contest exists. Entrants must comply with these Rules, and will be deemed to have received and understood the Rules if they participate in the Contest.
